Terms & Conditions :-

CLIENT : A client generally means a person, including a public officer, corporation, association or other organization or entity, either public or private, who is rendered services by a service provider, or who consults a service provider with an intention of obtaining services from him/her.

COOPERATION: The parties agree to cheerful cooperation and communication for the best possible result within the definition of this assignment. Fotocaters recommends that CLIENT designate an "event guide" to point out important individuals for informal or candid photographs to the photographer during the wedding that they wish to have photographed. The photographer will not be held accountable for not photographing desired part of event/people if there is no one to assist in identifying or gathering people or informing about any other part of event happening for photographs.

INTERFERANCE WITH PHOTOGRAPHER: It is the CLIENT’s responsibility to inform guests to avoid interfering with the photographer’s duties. The photographer, while shooting, will move in directions that he is not looking and has limited peripheral vision. It is especially important that small children are kept at a safe distance. While guests are permitted to photograph during the event but they should give our photographers preference to capture a important moment, not doing so might result into photographer’s inability to capture the important moments and they must avoid restricting our photographer’s movement anywhere on the venue or blocking the photographer’s view to take a shots.

FINAL IMAGES RENDERED TO CLIENT: Client has reviewed portfolio images and accepts image composition quality and the documentary style and artistic value of images photographed by Photographers of Fotocaters Photography Sales and Sercives. CLIENT shall hold Fotocaters harmless in any disputes arising from these issues.

SHOOTING TIME / ADDITIONS: The photography schedule and selected methodology are designed to accomplish the goals and wishes of the CLIENT in a manner enjoyed by all parties. CLIENT and Fotocaters agree that cheerful cooperation and punctuality are therefore essential to that purpose. Shooting commences at the scheduled start time and end time may extend to maximum 1 hour to the event timings given by the client, any delay to end the event by the client might be chargeable depending on the situation.

HOUSE RULES: The photographer is limited by the guidelines of the official or reception site management. CLIENT agrees to accept the technical results of their imposition on the photographer. Negotiation with the officials for moderation of guidelines is CLIENT’s responsibility; Fotocaters will offer technical recommendations only.

EXHIBITION: Fotocaters and CLIENT are the co-owners of the photographs clicked on the event day/days. CLIENT grants Fotocaters permission to display few best images which are approved by client for demonstration of Fotocaters’s work and for entrance into photographic competitions and release all claims to profits that may arise from use of images. Client's photos will only be for the exhibition purpose or demonstration of our work and will not be sold to any third party for any commercial purpose. Any commercial sale of Client's photographs will be done only after a written consent between Client, Fotocaters and Third Party.

LIMIT OF LIABILITY: In the unlikely event that the photographer is injured or becomes too ill to photograph the event, Fotocaters will make every effort to secure a replacement photographer. If the situation should occur and a suitable replacement is not found, responsibility and liability is limited to either try to cover the event with limited number of team member or to return of payment received for the particular services, if our photographers are unable to cover the event. Fotocaters takes the utmost care with respect to exposure, transportation, and processing the photographs. However, in the unlikely event that photographs have been lost, stolen, or destroyed for reasons within or beyond Fotocaters control before it is delivered to the client, Fotocaters liability is to bare cost for recovering the photos and videos in maximum ways possible known to Fotocaters or suggested by the client. And incase of no success the liability is to return of all payments received for the event package. To avoid such instance, Fotocaters also recommend client to provide an external computer hard drive for secure back up to be given to Fotocaters for making a backup copy and it will be delivered back to the client on the last day of the event and when the agreed balance amount is paid.

RETAINER / DEPOSITS: In the event of cancellation, the Retainer paid is nonrefundable. It shall be liquidated damages to Fotocaters in the event of a breach of contract by CLIENT. The CLIENT shall also be responsible for payment for any Fotocaters material charges incurred up to time of cancellation.

COMPLETION SCHEDULE: Image developing and Editing, Prints and book scan take up to 60 working days counted after the client's response to our procedures. Fotocaters will make all efforts for submitting the photos within the stipulated time. Incase of delay of more than 90 days in total by the client, after the responses given by Fotocaters in coordination for selection of photos or approval of the album drafts or video or any minor changes required in the photos or album. Fotocaters holds to right to charge 5% extra amount per 30 days delay after 90 days to client for delay in payments or holding the balance payment or not following the guidelines given by Fotocaters under this agreement.

SAFETY MEASURES (SPECIAL CLAUSE): All safety and hygiene related measure will be followed by Fotocaters Team as per the latest guidelines laid down by the Government of India or any local government authorities during the events.
